Law No. 379 of 14/12/2000 provides for the recognition of Italian citizenship in favor of persons born and resident in the territories of the former Austro-Hungarian Empire, as well as their descendants, provided they meet the necessary requirements.
The deadline for applications under Law No. 379/2000 expired on 19/12/2010.
Law No. 124 of 08/03/2006 provides for the recognition of Italian citizenship in favor of persons of Italian origin who lost citizenship because they resided between 1940 and 1947 in Istria, Fiume, and Dalmatia.
Recognition of Italian citizenship under special laws constitutes an acquisition of citizenship “by benefit of law.”
Therefore, it is not possible for a parent recognized as an Italian citizen under these provisions to submit the declaration of intent to acquire citizenship on behalf of a minor child as provided for under Article 4, paragraph 1-bis of Law No. 91/1992, because the recognized parent is not considered an Italian citizen by birth.
